2.1.2 German nationals and permanently resident members of the mission
Privileges, Immunities and Exemptions.
In such cases, the customary rotation pattern is no longer applicable. Secondment is no longer the prime feature of the residence in the receiving State. A change in status after ten years of residence is necessary in order to ensure the equal treatment of the group of persons concerned. The aim of diplomatic and consular law is to find a mutually agreed rule between the sending and the receiving States in order to prevent interference in the organisation of the missions.
The following uniform procedure is therefore applied:
At the start of the 7th year of the stay, the embassy is requested per Note Verbale to provide written notification of the expected further duration of the stay. As a rule, the protocol card (Protokollausweis) is extended by one year on receipt of this notification.
At the start of the 9th year of the stay, the embassy is asked, with reference to the maximum period of ten years, whether the individual is still subject to rotation.
Should this not be the case or should a limited further deployment beyond the 10th year of the stay be envisaged, notification in accordance with Article 10 (1) (d) of the VCDR or Article 24 (1) (d) of the VCCR is requested. This provides diplomatic missions with the opportunity to explain special exceptions.
